Unless we have entered into a separate written confidentiality agreement, communications and materials submitted through the website will not be considered confidential. You should not submit confidential, proprietary, or commercially sensitive information through a general website form.

Submitting music, recordings, compositions, demos, artwork, business proposals, or other creative materials does not create an attorney-client, fiduciary, employment, partnership, agency, management, publishing, recording, or other professional relationship between you and Fatmouth Music LLC.

We are not obligated to review, respond to, return, preserve, or compensate you for unsolicited materials.

Consent to receive marketing communications is not a condition of purchasing a product or service.

8. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using the website, you acknowledge that you have reviewed our Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference.

9. Third-Party Websites and Services

The website may contain links to third-party websites, streaming platforms, social-media services, payment services, ticketing platforms, or other external resources.

These links are provided for convenience only. We do not control and are not responsible for the availability, accuracy, content, security, products, services, or privacy practices of third parties.

Your use of a third-party website or service is governed by that third party’s own terms and policies.

The inclusion of a third-party link does not necessarily mean that Fatmouth Music LLC endorses or sponsors the third party.

10. Purchases and Separate Agreements

Certain products, services, licenses, events, subscriptions, or other transactions may be governed by additional terms presented at the time of purchase or contained in a separate written agreement.

Prices, availability, payment terms, refund policies, delivery terms, and other transaction details will be those presented at the time of the applicable transaction.

If these Terms conflict with a separately signed written agreement between you and Fatmouth Music LLC, the separately signed agreement will control regarding the subject matter of that agreement.

We may modify, update, suspend, restrict, or discontinue any portion of the website at any time.

We do not guarantee that the website or any particular content will always be available, accurate, complete, secure, or free from errors.

16. Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles.

Except where applicable law provides otherwise, legal proceedings arising from or relating to these Terms or the website must be brought in a state or federal court located in New Jersey. You and Fatmouth Music LLC consent to the jurisdiction of those courts.

Nothing in these Terms limits any consumer right or remedy that cannot legally be waived.

17. Changes to These Terms

We may update these Terms periodically.

When changes are made, we will update the effective date displayed at the top of this page. Material changes may also be communicated through the website, email, or another appropriate method.

Changes will apply prospectively from the effective date of the updated Terms unless otherwise permitted by law. Your continued use of the website after updated Terms become effective constitutes acceptance of those updated Terms.

The remaining provisions will remain in full force and effect.

19. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision in the future.
